Federal/State by State Uniform Birthfather Rights for Interstate Adoption [FSUBIA]

Hello out there.

A couple of days ago I posted a blog concerning this country's lack of BF rights concerning adoption. This problem has become more prevalent in the past years more so than at any other time in our nations past. In fact, individual states have previously enacted their own separate statutes and variances in adoption laws. Laws that herd the ever more willing majority of BFs into an eyes closed state of their "own private Idaho".

That said, presented are we,_ with 50 different sets of adoption statutes for each state in the union.

Things must change, the adoption of a child is not a financial equation. Although 9 out of 10 BFs are queitly counting sheep on a ranch in Idaho, the rest of the percentage deserve recognition.

Regardless of the manner in which he was denied of chance to take part or stop an adoption process, a BF still should have certain "unalianable" rights in his pusuit of happiness. It is also my opinion that an "unknown" BF be given these rights even if privy to the pending adoption itself. It is the right thing to do. Why afford these rights to an uncaring BF who cares not about the child in question? Some would say that such rights could possibly, if given, be twisted to allow the BF to come back months or years later claiming not to have been properly notified.

This may be true, however, right is right and it should not matter the possibility of the unscroupulous.

Sadly, rather than enact a law that provides equality in the triad of adoption, New Jersey instead signed into law, statute N.J.S.A. 9:3-39 1[b]. This brainstorm would in effect render the BF to the classification of Sperm Donor*, with an asterisk. An asterisk meanwhile cannot return to seek the reversal of a child placement.

It is just one opinion of course, but if my proposal for adoption and Birthfather reform were to become realized and accepted, only positive results would ensue. At the same time the benifits would only strengthen a finalized adoption, something N.J.S.A. 9:3-39 1[b] with it's seek and destroy practicality, failed at miserably.
